Terms Relating to Notarization
Do you need someone to notarize the title of your automobile or a loan modification package, & the deed to a piece of property you own? If so, you'll need to hire a Notary Public to take care of your personal documentation. But before you rush out to hire anyone, familiarize yourself with a few of these terms:
- Notary Public -
A Notary Public is an official of integrity appointed by state government—typically by the secretary of state — to serve the public as an impartial witness in performing a variety of official fraud-deterrent acts related to the signing of important documents. These official acts are called notarization's or notarial acts. Notaries are publicly commissioned as “ministerial” officials, meaning that they are expected to follow written rules without the exercise of significant personal discretion, as would be the case with a “judicial” official.
- Notary Signing Agent
is a Notary specifically trained to facilitate mortgage closings. Mortgage lenders, title firms and escrow companies are paying Notary Signing Agent professionals to make loan closings as convenient as possible for borrowers by couriering loan documents, collecting and notarizing signatures and delivering settlement checks.
- Certificate -
Once a document has been notarized, it becomes an official certificate, and it can be used in a court of law. Just about any sort of document can become a certificate. Business documents, financial documents, jurats, and loans can all be certified, for instance.
- Mobile Notary -
Most notary agents are highly mobile. This means that they are willing and able to travel around their city or county, notarizing documents wherever they are needed most.
§ 8211. Fees
Fees charged by a notary public for the following services shall not exceed the fees prescribed by this section.
(a) For taking an acknowledgment or proof of a deed, or other instrument, to include the seal and the writing of the certificate, the sum of ten dollars ($10) for each signature taken.
(b) For administering an oath or affirmation to one person and executing the jurat, including the seal, the sum of ten dollars ($10).
Travel Fees apply to all mobile signings on top
of the $10 fee per signature requirement
Loan Signing Agent Services
•Receive loan package, documents through e-mail or local pick-up
•Meet with signer at signer's home, or location of choice
•Documents are signed dated and notarized then shipped back ASAP
Mail-away loan documents
- title company sends loan documents by overnight courier to a borrower & instructs him or her to find a notary to notarize several of the documents in the package.
- borrower pays notary for the work performed; there is no interaction between the notary and the title company.
- borrowers returns the documents to the title company in a timely manner.
